1. Introduction

Welcome to nTravo, where we connect travelers with local guides for unique experiences. By booking services through nTravo, you agree to these Terms and Conditions ("Agreement"). This Agreement is a binding contract between nTravo and you ("Traveler" or "You").

2. Definitions

  • nTravo: The platform operated by nTravo that connects local guides with travelers.
  • Traveler: Any individual using the nTravo platform to book services.
  • Guide or Local Guide: A person or entity offering services through the nTravo platform.
  • Services: The experiences, tours, or activities offered by Guides through nTravo.
  • Platform: The website and mobile applications operated by nTravo.

3. Booking Services

  1. Account Creation: Travelers may create an account on nTravo to book services. Account information must be accurate, and travelers are responsible for maintaining the confidentiality of their login credentials.
  2. Service Listings: Travelers can browse and book services listed by Guides. The details of each service, including pricing, availability, and any specific requirements, are provided by the Guides.
  3. Booking Confirmation: A booking is only confirmed when the Traveler receives a confirmation email from nTravo. Travelers should review the confirmation details carefully and notify nTravo of any discrepancies immediately.

4. Payments and Cancellations

  1. Payment: Travelers must pay the full amount at the time of booking. Payments are processed through nTravo’s secure payment system. Travelers are not required to make any additional payments directly to the Guide.
  2. Cancellation Policy: Travelers may cancel their bookings in accordance with nTravo’s cancellation policy. Refunds are issued based on the timing of the cancellation and any specific localGuideTermsData set by the Guide.
  3. Changes to Bookings: Any changes to a booking, including date, time, or number of participants, must be requested through the nTravo platform. Changes are subject to availability and may incur additional charges.

5. Conduct and Responsibilities

  1. Traveler Conduct: Travelers are expected to behave respectfully and follow the instructions of the Guide during the service. Disruptive behavior or failure to comply with the Guide’s instructions may result in the termination of the service without a refund.
  2. Assumption of Risk: Travelers acknowledge that certain services may involve inherent risks, including but not limited to physical activity or travel in remote areas. By booking a service, Travelers assume all risks associated with the service and agree that nTravo is not liable for any injuries, damages, or losses.
  3. Health and Safety: Travelers are responsible for ensuring that they are physically and mentally fit to participate in the service. Any health concerns should be communicated to the Guide in advance.

6. Reviews and Feedback

  1. Submitting Reviews: After completing a service, Travelers may leave a review on the nTravo platform. Reviews should be honest, constructive, and based on the Traveler’s personal experience.
  2. Use of Reviews: nTravo reserves the right to use, display, or remove reviews at its discretion. Reviews are public and may be viewed by other users on the platform.

7. Intellectual Property

  1. Content Ownership: All content on the nTravo platform, including text, images, and videos, is the property of nTravo or its content providers. Travelers may not use or reproduce any content from the platform without permission.
  2. User-Generated Content: By submitting reviews or other content, Travelers grant nTravo a non-exclusive, worldwide, royalty-free license to use, display, and distribute the content in connection with the platform.

8. Liability and Disclaimers

  1. Limitation of Liability: nTravo’s liability to Travelers is limited to the amount paid for the service. nTravo is not responsible for any indirect, incidental, or consequential damages arising from the use of the platform or participation in any service.
  2. Service Disclaimer: nTravo acts as an intermediary between Travelers and Guides. nTravo does not guarantee the quality, safety, or accuracy of any services provided by Guides and is not responsible for any actions or omissions by Guides.

9. Dispute Resolution

  1. Complaints: In case of a complaint about a service, Travelers should contact nTravo within 24 hours of the service completion. nTravo will mediate between the Traveler and the Guide to resolve the issue.
  2. Legal Disputes:
  • Any legal disputes arising out of this Agreement will be governed by the laws of the applicable jurisdiction and will be subject to the exclusive jurisdiction of the relevant courts.
  • The specific jurisdiction and governing law applicable to this Agreement will be determined and communicated to the Traveler upon formal registration of the company and will be incorporated by reference into this Agreement.
  • Until the formal registration of the company, any disputes arising out of this agreement will be handled in good faith between the parties, with the formal jurisdiction to be determined upon registration.
  • nTravo reserves the right to update the jurisdiction and governing law applicable to this Agreement following the registration of the company. Any such updates will be communicated to the Travelers and will take effect immediately upon notification.

10. Changes to the Agreement

nTravo reserves the right to amend this Agreement at any time. Travelers will be notified of any significant changes via email or through the platform. Continued use of the platform after such changes constitutes acceptance of the new localGuideTermsData, including any updates to the governing jurisdiction.

11. Miscellaneous

  1. Confidentiality: Travelers agree to keep any confidential information shared by nTravo or Guides secure and not to disclose it to any third party.
  2. Entire Agreement: This Agreement constitutes the entire understanding between nTravo and the Traveler, superseding any prior agreements or understandings.
